Terms & Conditions of use for the Skychemwin Services/Products (on Legal Basis)
General Terms
Welcome to Skychemwin website (hereinafter referred to as "Site")
that provides the services/products as described on the Site to you and you are
subject to these terms and conditions. Your use of this Site prompts you to
read, agree with and accept all of the terms and conditions contained
hereinafter.
Modifications and/or Changes
Skychemwin may modify these terms and conditions, in whole or in part, at any
time and in its sole discretion. Such modifications will be effective when
posted on this Site, so please review these terms and conditions regularly in
connection with your use of this Site. Your continued use of this Site
constitutes acceptance of these terms and conditions as modified. Skychemwin
may also terminate, change, or otherwise modify any aspect of this Site to keep
services/products update, in whole or in part, to this Site at any time and in
its sole discretion without liability.
Place Orders
All orders are subject to availability. When your requirement is received, Skychemwin
will confirm receipt. If there are any changes, Skychemwin will contact you in
advance. Invoices should be paid no later than 30 days after the invoice date,
and customers must themselves pay any bank charges that are incurred in making
the payment. Full payment instructions are set out on the invoice.
Services
Service defines that the Site provides services and other additional
information through www.chemsky-cn.com to be provided
by Skychemwin hereunder. To be eligible for our services, you shall obtain the
consent of service/product specifications for use from Skychemwin and make an
agreement.
Receipt of Products
Packaging and products should be inspected immediately upon receipt.
Notification of damage, shortages or defects should be given immediately by
e-mail or fax.
Liability
(1). Skychemwin shall provide the services/products as per requested within
appointed time otherwise further agreement or force majeure (such as
earthquake, a war of the elements, flood, typhoon, etc). Skychemwin shall not
disclose your personal information to any third party that is not directly
related to the agreement and will limit to use and improve high quality
service, unless the disclosure is requires by the law, regulations or orders of
the governmental authorities concerned national security and safety in very
exceptional case.
(2). You shall abide by clauses specified on the agreement and related laws.
You agree to acknowledge that any data/results/products generated from Skychemwin
and delivered to you resulted from labor, efforts, material and assets of Skychemwin
and its affiliated entities, and that you shall be liable for the payments of
the processed order regardless of the success or fail of the services/products
if without further agreement.
Disclaimer & Limitation of Liability
You agree that your use of services/products listed on this Site shall be at
your sole risk. The operation of this Site and the information available
thereon are provided "as is". To the fullest extent permitted by law,
Skychemwin and its affiliations/offices/employees/agents disclaim all
warranties, express or implied in connection with this Site and your use
thereof. All Skychemwin products/services are intended for specific use
(usually it will be specified during the time reaching agreement) and Skychemwin
will not be liable for any professional advice it may offer in relation to the
use of the products nor any claims or applications not listed in the literature
or the misuse of products/services which will include using the
products/services. Skychemwin cannot provide a guarantee for all applications
for which a specific reagent may be used. Skychemwin shall not be liable for
its failure to perform any of its obligations resulting from conditions beyond
its reasonable control. Except for the express warranties set out in these
terms, all other warranties express or implied, statutory or otherwise are
hereby excluded to the extent permissible by law.
